Gas Certificates

Each year nearly thirty people die in the United Kingdom because of poorly maintained or badly installed gas appliances that result in carbon monoxide poisoning. By obtaining an annual heating certification check, you can ensure that this won’t happen to your property or your family.

Understanding Gas Certification

Under the law, it is the obligation of all home owners to obtain a gas certificate (CP 12) every 12 months. According to the Gas Safety Regulations, the inspection of all flues, gas appliances, and pipe work must be completed by a Gas Safe Registered engineer.

If you do not comply with these regulations, you could face severe penalties as it is a criminal offence. Courts possess the authority to impose custodial sentences and unlimited fines for any home owner found guilty of non-compliance. In addition, non-compliance can also invalidate your property insurance, triggering a possible civil suit where awards for damages have proven to be costly.

Responsibilities of Landlords & Agents

If you are a residential landlord, you or your appointed agent, are legally responsible for the safety of your tenants and for compliance with the Gas Safety Regulations enforced by the Health & Safety Executive. These regulations require landlords to ensure that the installation of gas appliances, fittings, and flues provided for tenants are in safe working order. For residential properties, it is a statutory requirement for all landlords or agents to arrange Gas Safety Checks on an annual basis performed exclusively by a Gas Safe Registered Engineer.

The landlord must provide to the tenant a copy of the Gas Safety Certificate upon occupying the property and within 28 days of the annual inspection. The landlord must also retain a copy of the Gas Safety Certificate for a period of 2 years. Non-compliance can lead to severe penalties and should deaths result from failure to comply, manslaughter charges may apply to landlords and agents.

For residential landlords that contract agents to manage properties, it is critical that the management contract clearly states who is responsible for the maintenance of gas appliances. Copies of this paperwork should always be kept by both parties. When the contract passes responsibility to an agent, the agent must demonstrate compliance with Gas Safety Regulations on behalf of the landlord.

Although there is a legal obligation for gas safety inspections on an annual basis, it is highly recommended that these checks are also performed between tenants. Not only will it ensure that your gas appliances are in safe condition, it will ensure that they are operating efficiently. Landlord certification not only demonstrates compliance with the law, but it also offers peace of mind for both tenants and landlords that their property is safe and protected.
